Terms of Use

These Terms of Use (the “Terms” or “EULA”) form a legal agreement between you and Sangita Gautam (“we,” “us,” or “our”) governing your use of the CountDown: Days Until Widget application for iOS (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.

1. Your Content

The countdowns you create, and the titles, dates, notes and photos you put in them, are your content. You keep all rights you already hold in it. We claim no ownership, and because everything is processed on your device, we never receive, store, or access it.

You are responsible for having the right to use any photo you add to a countdown, and for the content of anything you share — for example a celebration image you post or send.

2. Acknowledgement Regarding Apple

These Terms are concluded between you and Sangita Gautam only, and not with Apple Inc. (“Apple”). Sangita Gautam, not Apple, is solely responsible for the App and its content. Apple is not a party to these Terms. You acknowledge that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

3. License

Sangita Gautam grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store’s Usage Rules set out in Apple’s Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, decompile, distribute, sell, rent, sublicense, or create derivative works of the App, except to the extent such restriction is prohibited by applicable law.

4. Free Plan and CountDown Premium

The App is free to download and free to use. The free plan keeps up to 5 active countdowns and includes the standard wallpapers and a reminder at the time of the event. CountDown Premium is an optional auto-renewing subscription that removes the limit and unlocks the rest.

• What Premium unlocks: unlimited countdowns, every wallpaper pack, reminders before the event and at a time you choose, and all Home Screen and Lock Screen widgets.
• Plans: CountDown Premium Weekly and CountDown Premium Monthly. The price of each plan is shown in the App and on the App Store before you subscribe, in your local currency, and may vary by country.
• Free trial: each plan starts with a 3-day free trial for eligible new subscribers. Apple allows one free trial per person across both plans. If you don’t cancel during the trial, the subscription begins and you are charged when the trial ends.
• Payment: payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends.
• Automatic renewal: your subscription renews automatically at the end of each period (week or month) at the then-current price, unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the current period ends.
• Cancelling: you can manage or cancel your subscription at any time in Settings → [your name] → Subscriptions on your iPhone. Cancelling stops future renewals; you keep Premium until the end of the period you have paid for.
• Restoring: your subscription is tied to your Apple Account. If you reinstall the App or use another device you own, tap Restore purchases in the App.
• Price changes: if we change a subscription’s price, Apple will notify you in advance as required by its rules, and where required you will be asked to agree before the new price applies.
• When a subscription ends: Premium features lock, and countdowns beyond the free limit become read-only rather than being deleted. Your countdowns stay on your device and become fully available again when you resubscribe or restore.

5. Refunds

All purchases are processed by Apple and are subject to Apple’s refund policies. Sangita Gautam does not process payments and generally cannot issue refunds directly. Refund requests are handled by Apple and may be submitted at reportaproblem.apple.com. Except where required by law, payments are non-refundable.

6. Reminders, Widgets, and Live Activities

While we work to make reminders reliable, they are delivered by iOS and depend on your device, its operating system, battery, network, and your notification, Focus and power settings — all of which are outside our control. A reminder may therefore be delayed, silenced, or fail to appear. Widgets and Live Activities are refreshed by iOS on its own schedule and may briefly show an out-of-date figure.

You should not rely on the App as your only reminder for anything important or time-critical — such as a flight, an exam, a deadline, an appointment or a payment. Please keep a separate reminder for anything that matters. To the fullest extent permitted by law, Sangita Gautam is not responsible or liable for any missed event, loss, cost or other consequence arising from a reminder that is late, silenced, or not delivered.

7. Your Data, Backups, and Export

Your countdowns, automatic backups and exported files are stored on your device. We do not keep copies and cannot recover them for you. They may be included in your own iCloud or computer backups of your device. You are responsible for backing up anything you want to keep. Data may be lost if you uninstall the App, if your device is lost, damaged, or reset, or if the App is updated or removed from sale. We recommend exporting your countdowns from time to time and keeping the file somewhere safe.

8. Acceptable Use

You agree to use the App only for lawful purposes, and not to use it to create or share content that infringes anyone’s rights, is unlawful, defamatory, harassing, hateful, threatening or obscene, or that sexually exploits or endangers a minor. You also agree not to misuse the App, interfere with its operation, or attempt to access it using a method other than the interface and instructions we provide. Because your content stays on your device, we cannot monitor or moderate it — responsibility for what you create rests entirely with you.

9. Photos and Permissions

With your permission, the App sends you notifications and lets you pick a photo as a countdown background using Apple’s system picker. You control each permission and can change it at any time in Settings → Privacy & Security. We handle this access as described in our Privacy Policy — in particular, your countdowns and photos are processed only on your device and are never uploaded, never used for advertising, and never sold.

10. Intellectual Property

The App, including its software, design, text, graphics, logos, icons, templates, wallpapers and other supplied artwork, is owned by Sangita Gautam or its licensors and is protected by intellectual-property laws. The wallpapers and icons the App provides are licensed to you for use within countdowns you create with the App, including sharing those countdowns. You may not extract, redistribute, resell, or sublicense them on their own. Except for the license granted above, no rights are transferred to you. This does not affect your ownership of your own content, as described in Section 1.

11. Maintenance and Support

Sangita Gautam is solely responsible for providing any maintenance and support services for the App, as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the App. For support, contact us at gautamsangita372@gmail.com.

12. Warranty

To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Sangita Gautam’s sole responsibility.

13. Limitation of Liability

To the fullest extent permitted by law, Sangita Gautam will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, countdowns, or backups, arising out of or relating to your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App and any subscription in the twelve months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Indemnity

You agree to indemnify and hold harmless Sangita Gautam from any claim, demand, loss, or expense (including reasonable legal fees) arising out of content you create, store, or share using the App, or out of your breach of these Terms.

15. Product Claims

Sangita Gautam, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product-liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation.

16. Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Sangita Gautam, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by these Terms.

17. Legal Compliance and Export

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable laws when using the App.

18. Termination

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of their provisions. Upon termination, you must stop using the App and delete all copies. Sections relating to your content, intellectual property, warranties, liability, and indemnification survive termination.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

20. Governing Law

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules, except where local consumer-protection laws require otherwise. This does not affect the application of mandatory consumer-protection provisions of your country of residence.
